Section 1 Errors
NEW
- Section 1 of the I-9 must be completed by the employee no later than the end of the first day of work for pay. .
- Section 1 must be inspected prior to completing Section 2.
- Employees must use their legal name in Section 1.
- If the employee has one name, they must put “Unknown” in the First Name field and their name in the Last Name field.
- Employees do not enter their USCIS number or “work until date”.

Failure to Reinspect Section 1
Legal Name Errors
- Cannot use nickname
- If employee has one name, I-9 user must put unknown in first name field and employee’s name in the last name field.
Late Section 1
- A concern on the employee side of completing an I-9: Employees not entering their USCIS number or their work until date (while this is on the employee side, it is also important for employer to know of this issue). With this, the I-9 user is not reinspecting the Section 1 from the employee.
- The employee’s legal name doesn’t match HRS (for example: nicknames are used)
- Completing a late Section 1 and Section 2
- When the employee has one name, the I-9 user must put unknown in the first name field and the employee’s name in the last name field
